This Rental Agreement is between Moovalot, LLC ("Owner") and the individual renting the equipment ("Renter"), as identified in the Moovalot App.

1. Rental Period

The rental period begins at the time payment is completed in the App and ends when equipment is returned to the designated Pickup/Dropoff location. Rental periods are charged in 15-minute increments. Late returns are charged the Extended Time Rental Fee in 15-minute increments.

2. Rental Fee & Payment

Renter pays the agreed Rental Fee in advance through the App. Additional time may be purchased through the App at the applicable Extended Time Rental Fee.

3. Security Deposit

A refundable security deposit of up to $500 may be required to cover potential damages, late fees, or other charges. The deposit is returned upon satisfactory inspection and timely return of equipment.

4. Condition of Equipment

Renter acknowledges inspecting the equipment before renting and accepts it in its current condition. Pre-existing damages must be reported to the Owner before use. Equipment must be returned in the same condition, except for normal wear and tear.

5. Damage Responsibility

Renter is responsible for all damage beyond normal wear and tear. Cleaning or repair costs, including replacement of missing components, will be charged to the Renter.

6. Tire Care

Renter is responsible for checking road and jobsite conditions to avoid tire damage. All tire repairs during the rental period are the Renter's responsibility.

7. Towing Requirements

Renter must ensure their vehicle has the necessary hitch and towing capacity. All trailers require a 2" ball hitch and the towing vehicle must support a maximum weight of 3,500 lbs.

8. Accidents & Theft

In the event of an accident or theft, Renter must notify Owner and local law enforcement within one (1) hour of discovery. Failure to report may result in additional penalties.

9. Prohibited Uses

Equipment must not be used for illegal activities or in unsafe conditions. Renter may not take equipment outside the State of Texas without prior written consent from Owner.

10. Lost or Unreturned Equipment

If equipment is stolen, destroyed, or not returned within 12 hours of the Rental Period End Time, it will be deemed a total loss and Renter will be charged a $5,000 replacement fee. If returned in good condition after the fee is paid, a refund minus penalties will be processed.

11. Insurance

Renter must maintain valid insurance on the towing vehicle covering the rented equipment for the duration of the rental period.

12. Repossession

Owner reserves the right to repossess equipment at any time if Renter violates any term of this Agreement. Renter consents to Owner entering their premises for repossession purposes.

13. Indemnification

Renter agrees to indemnify and hold Owner harmless against any claims, liabilities, or damages arising from Renter's use of the equipment, including third-party claims for personal injury or property damage.

14. Limitation of Liability

OWNER'S LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM THIS AGREEMENT SHALL NOT EXCEED THE TOTAL FEES PAID BY RENTER TO OWNER.

15. Warranty Disclaimer

THE EQUIPMENT IS PROVIDED "AS-IS" WITHOUT WARRANTY OF ANY KIND. OWNER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

16. Environmental Responsibility

Renter agrees not to use the equipment to transport or dispose of any hazardous materials in violation of environmental laws.

17. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of Texas. All disputes will be settled through binding arbitration in Harris County, Texas, under the rules of the American Arbitration Association.

18. Subletting / Unauthorized Use

Renter agrees not to sublease, rent, or allow any unauthorized third party to use the equipment without prior written consent from Owner.

19. Credit Card Authorization

Renter authorizes Owner to charge the payment method on file for any unpaid fees, damages, or penalties incurred during the rental period.

20. Equipment Misuse

Renter agrees to use equipment solely for its intended purpose. Misuse will result in immediate termination and liability for damages.

21. Failure to Return

If equipment is not returned within 6 hours of the Rental Period End Time, Owner reserves the right to charge the full replacement value, up to $5,000.

22. Entire Agreement

By checking the acceptance box in the Moovalot App, Renter acknowledges they have read and agree to all terms and conditions of this Agreement.
